Request for Comment: Proposed Chief Judge Practice Direction on Subpoenas Against Opposing Counsel

The Provincial Court seeks comments from members of the legal community who are involved in litigation on a proposed Practice Direction which sets out the procedure for issuing subpoenas against opposing counsel in the Provincial Court. 

The proposed directions are:

  1. Before a subpoena against opposing counsel is issued, the proponent of the subpoena must notify counsel who will be subject to the subpoena.
  2. For criminal matters, an application must be made on the record before a judge.
