The Provincial Court seeks comments from members of the legal community who are involved in litigation on a proposed Practice Direction which sets out the procedure for issuing subpoenas against opposing counsel in the Provincial Court.
The proposed directions are:
- Before a subpoena against opposing counsel is issued, the proponent of the subpoena must notify counsel who will be subject to the subpoena.
- For criminal matters, an application must be made on the record before a judge.
