On October 14, CBABC delivered a submission responding to the BC Supreme Court’s call for suggestions on its role in advancing Reconciliation.
While progress has been made, systemic challenges persist, particularly in recognizing Indigenous legal orders, respecting cultural protocols, and ensuring equitable participation in Court processes.
Our 13 recommendations to the Court include calls to:
- Engage in ongoing consultation with Indigenous communities;
- Develop and recommend amendments to the Rules of Court and Court procedure to clarify procedures for admission and enforcement of Indigenous laws and legal orders;
- Provide ongoing education to judges and Court staff.
The submission is based on engagement with CBABC’s membership, including the Aboriginal Lawyers Forum and the Truth & Reconciliation, Access to Justice, Court Services and Family Law Committees.
