Synopsis: Effective as of October 1, 2020, all private companies existing under the Business Corporations Act (British Columbia) (the “BCBCA”) are required to establish and maintain a transparency register of “significant individuals.” Lawyers acting for BC companies should be informed and prepared to advise their clients in complying with the new BCBCA transparency register requirements.
In this section meeting, Eric Lung and Dierk Ullrich provided practical advice and guidance regarding navigating the new transparency register requirements, including the implementation of questionnaires, checklists and other systems. They also demonstrated the application of the new BCBCA requirements to common corporate ownership structures.
