Synopsis: The “eCourt” Initiative: How Technology Will Change Our Courts - Inside and Out

Synopsis: Indivisible injuries - Bradley v. Groves, 2009 BCSC 1882, 2010 BCCA 361 explored the task of separating liability for injuries suffered in multiple actions amongst tortfeasors. The trial decision (upheld on appeal) held that where injuries are indivisible, and in the absence of contributory negligence, a plaintiff may collect the entire damages awarded from either of the liable tortfeasors.

Comments and Observations of the Chair

The Section worked closely with the Criminal Justice-Vancouver Island and Family Law-Victoria Sections to host a meeting regarding the e-court initiative and then worked with the Insurance Law Section to address the case of Groves. Additionally the Section proposed further meetings in January and April that were cancelled (in one case due to heavy snowfall - yes it snowed in Victoria!).

Through the various meetings the Section enhanced individual understanding of various topics and further promoted collegiality across the Bar. In this regard the Section had a successful year and added value to members of the CBA.
