Meeting Title/Topic: Marchi v. Nelson Case Update and Discussion
Synopsis: The Supreme Court of Canada recently granted leave to appeal the decision of the B.C. Court of Appeal in Marchi v Nelson (City of), 2020 BCCA 1. This section meeting hosted a panel of counsel on the case as well as municipal insurers who discussed the issues and implications involved as this case heads to the Supreme Court of Canada. The case concerned an injury sustained in a snowbank on municipal property. The key question on appeal was whether certain acts or omissions on the part of the City of Nelson should be considered policy decisions and thus ought to be insulated from judicial scrutiny.
