NP 32: Official of the Court Under Rule 62(G.1) of the Provincial Court Family Rules

Purpose
To describe who is available to serve as an “official of the court” for the purposes of Rule 62(g.1) of the Provincial Court Family Rules, B.C. Reg. 120/2020, which authorizes a judge to make a case management order about authorizing an official of the court, in accordance with section 10 of the federal Family Orders and Agreements Enforcement Assistance Act, to make an application under section 12 of that Act to request that specified information related to a person’s income, location or employer is searched for in prescribed federal information banks and, if located, disclosed.

Notice
1. A “search officer” as defined in section 235 of the Family Law Act, S.C.B.C. 2011, c. 25 may act as an “official of the court” for the purposes of Rule 62(g.1) of the Provincial Court Family Rules.
